Privacy Policy

In our privacy policy, we inform you about what information, why, and where we request and store your (personal) data. We ensure that your privacy is safeguarded and that your personal data is secure with us, so that you can shop with peace of mind.

When processing personal data in the Netherlands, as of 25 May 2018 we are bound by the General Data Protection Regulation. In this privacy policy, we explain how we protect your privacy and how we handle your personal data. Do you have questions about this privacy policy? Then you can also read in this policy how to contact us about this.

Legal grounds for storing your data

According to privacy legislation, we must inform you about the legal grounds we have for using your data. Among other things, we need your data to help ensure that your order is delivered properly, to guarantee the warranty on your product(s), and to safeguard other contractual agreements. This applies in the case of:

Placing order(s)
Delivering your order(s)
Handling returns and service cases
Safeguarding your right to warranty
Contact with our customer service

In addition, we may use your data based on ‘legitimate interest’. This means that we want to provide all our customers with the most optimal, personal service. In doing so, we always consider your privacy. This applies to:

Reviews and customer satisfaction surveys
Contact with our customer service
Visits to our website
Creating an account
Newsletter and email(s)
Personal advice
Promotions
Social media

We may also have a legal obligation to use your data, for example when we suspect fraud. Sometimes you have given us permission to use your data yourself, such as when you sign up for our newsletter. You can of course unsubscribe from this at any time.

Who has access to your data?

We only share your data with other parties if this is truly necessary for our services. These parties include: delivery partners, product support, payment partners, trade information agencies, IT service providers, and parties that collect our reviews. Our delivery partner must, after all, deliver your order to the correct address. Parties such as data management platforms, media and advertising agencies, and research agencies come into play when we want to provide you with personal advice or show targeted advertisements, for example based on your interest in certain products. In suspicious situations, we are required to share customer data with government authorities.

The parties that gain access to your data from us may only use it to provide you with a service on behalf of Maboba, unless they are themselves responsible for obtaining and protecting your data. We promise that we will not unnecessarily share or sell your data with or to third parties.

Where is your data stored?

Your data is only stored in places where this is necessary, mainly under our own management. In addition, this also takes place with several parties we collaborate with, which are mainly located within the European Union (EU). Some parties are located outside the EU, for example Google. For these parties, we have carefully verified that they comply with privacy legislation and that your data is fully secure.

How long do we retain your data?

We do not retain and use your data longer than necessary. After that, we delete all data we have from you. Or we use your data anonymously, because we need certain data for internal analyses and reports such as the value of your order. We apply certain retention periods, after which we delete your data. These are:

Recorded telephone conversations are deleted by default after 30 days, unless we have a legal obligation to retain a conversation longer.
Inactive customer accounts are deleted after 7 years. After that period, we only use your data anonymously for internal reporting.
The Tax Authorities require us to retain our administration with your invoice, payment and order data for 7 years. After that, we only use anonymous data for internal reporting. You should also keep your invoices for your purchases, for example in case your warranty expires.
If you have subscribed to the newsletter or given permission to receive personalised messages, we retain that consent for 5 years. Even if you later decide that you no longer wish to receive the newsletter or personalised messages, we retain the withdrawal of your request. The emails you receive from us are not retained for longer than 60 days. So you do not have to worry about receiving the same email from us more often. After that period, we only use your data anonymously for internal reporting.

What are your rights?

Of course, you remain in control of your data. If you would like to access the data we have stored about you and/or receive a copy or have data amended, please contact us by phone, email, or post. In the same way, you can object to the use of your data for marketing purposes, the outcome of a credit check if you purchase something from us on instalments, or indicate that you believe your privacy outweighs our interest. In that case, we will reassess the situation. Would you like us to transfer your data to another party? That is also possible. Send your request by post or email and we will arrange it.

Unsubscribing from the newsletter is of course easy; you can do this in your account or via the link at the bottom of the newsletter itself.

Do you have questions or complaints?

The Dutch Data Protection Authority supervises whether companies comply with the General Data Protection Regulation. If you have questions or complaints, or simply want to access your stored (personal) data, please contact us via our contact form or send an email to info@thebluewavecollective.com. We are happy to help you find a solution. If this is not successful, you of course have the right to file a complaint with the Dutch Data Protection Authority.
